Terms of Service

These Terms govern your use of Zentable. By creating an account or using the Service, you accept these Terms on behalf of your restaurant. If you don't accept them, please don't use the Service.

1. Who we are

Zentable ("we", "us", "Zentable") is the operator of zentable.app and related software for restaurants — a QR-based digital menu, ordering flow, and customer-relationship platform (the "Service"). For the purpose of LSSI-CE (Spain) art. 10, our contact email is hello@zentable.app.

2. Who the parties are

Restaurant — the establishment that signs up and pays for the Service. Diner or Customer — individuals who scan a QR code and interact with a Restaurant's menu. Zentable has a direct contractual relationship only with the Restaurant; the Restaurant remains responsible for its own diners.

3. What's included

Free tier: digital menu up to 40 items, unlimited tables, QR generation, per-seat ordering, kitchen view, basic order tracking, and receipt-delivery infrastructure.

Paid tiers (Pro, Business, Enterprise): additional features including loyalty, campaigns, analytics, custom branding, staff accounts, reservations, POS integrations, and the Verifactu fiscal module — as listed at zentable.app/precios. Features ship continuously; we may add, change, or retire individual features within a tier as the product evolves, on reasonable notice.

4. Subscription, billing & cancellation

Paid plans are billed monthly or annually in advance via Stripe. Prices are shown in EUR (default) or your account's currency on the pricing page. VAT/IVA is added where legally required.

You can cancel at any time from Dashboard → Settings → Billing. Cancellation takes effect at the end of the current billing period. We don't pro-rate refunds for partial periods unless required by law (in particular Spain's 14-day withdrawal right for first-time consumer purchases — note this typically doesn't apply to B2B subscriptions).

We may suspend or terminate accounts for non-payment after at least one written reminder.

5. Payments between diners and restaurants

Zentable does not process payments between diners and Restaurants. Diners pay the Restaurant directly via the Restaurant's own point-of-sale or card terminal. Zentable's only financial relationship is its SaaS subscription with the Restaurant.

6. Data protection (summary)

The Restaurant is the data controller for its diners' personal data. Zentable is the data processor, acting only on the Restaurant's instructions. Zentable stores customer data on behalf of each Restaurant in strict tenant isolation — one Restaurant cannot read another Restaurant's customers.

By accepting these Terms you also accept our Data Processing Addendum, which is incorporated by reference. Full privacy practices, retention schedules, sub-processors, and EU/EEA transfer safeguards are documented in the Privacy Policy.

7. Acceptable use

You agree not to use the Service to host illegal content, send unsolicited commercial messages, infringe intellectual property, or interfere with the Service's operation. Specifically, you must not: probe or scan the Service for vulnerabilities (use security@zentable.app for responsible disclosure), use the API in a way that materially burdens other tenants, or scrape diner contact data for purposes outside the consent the diner gave.

We may suspend or terminate accounts that breach these rules, with notice where reasonable.

8. Service availability

We aim for 99.9% monthly uptime for the dashboard and customer-facing menu (/r/*). Planned maintenance is announced in-app at least 48 hours in advance. We don't guarantee uptime in writing as an SLA on the Free tier; Business/Enterprise plans can request a written SLA — email hello@zentable.app.

9. Intellectual property

You retain all rights to the content you upload (menu items, photos, descriptions). You grant us a limited, non-exclusive license to host, display, and process that content as needed to provide the Service — including transient processing by AI subprocessors when you opt in to features like AI menu import. We retain all rights to Zentable's own software, design, and branding.

10. Liability

The Service is provided "as is" and "as available"without warranty of any kind, except where unwaivable under applicable consumer law. To the maximum extent permitted by law, Zentable's total liability for any claim is limited to the fees you paid in the three (3) months preceding the event giving rise to the claim.

Neither party is liable for indirect, incidental, or consequential loss (lost profits, lost data beyond our backup obligations, lost goodwill). Nothing in these Terms limits liability for fraud, gross negligence, or anything that cannot lawfully be limited.

11. Governing law & disputes

These Terms are governed by the laws of Spain. The courts of Madrid have exclusive jurisdiction, except that consumers (where applicable) may bring proceedings in their habitual residence, and we may seek injunctive relief in any competent court to protect our intellectual property.

EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

12. Changes to these terms

We may update these Terms when the Service evolves. Material changes are announced in-app and by email at least 30 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms. The "Last updated" date at the top of this page reflects the most recent revision.
